Welcome to Sierra Hygiene Products. These Terms of Service (“Terms”) govern your access to and use of the Sierra Hygiene Products website, including our online store, products, services, features, and content (collectively, the “Services”).
The Services are operated by Sierra Hygiene Products (“Sierra Hygiene,” “we,” “us,” or “our”).
By accessing our website, creating an account, placing an order, or purchasing products from us, you agree to these Terms. If you do not agree to these Terms, please do not use our Services.
1. ELIGIBILITY AND USE OF OUR WEBSITE
Our website is available to individual consumers and businesses purchasing Sierra Hygiene products.
By using our website or placing an order, you represent that you are legally capable of entering into a binding agreement. If you are purchasing on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
You agree not to use our website or Services for any unlawful, fraudulent, abusive, or unauthorized purpose.
2. PRODUCTS AND PRODUCT INFORMATION
Sierra Hygiene Products manufactures and sells paper products, hygiene products, foodservice products, dispensers, and related goods.
We make reasonable efforts to ensure that product descriptions, specifications, dimensions, photographs, packaging information, case quantities, compatibility information, and other product details displayed on our website are accurate.
However, product appearance, packaging, dimensions, colors, embossing patterns, materials, specifications, or other characteristics may occasionally vary from photographs or descriptions due to manufacturing improvements, raw material availability, supplier changes, or other production considerations.
We reserve the right to modify, improve, discontinue, or replace products at any time without prior notice, provided that such changes do not materially affect an order already accepted by us unless otherwise communicated to the customer.
3. PRICING
All prices displayed on our website are in U.S. dollars unless otherwise stated.
Prices may change at any time without notice. The price applicable to an order will generally be the price displayed at the time the order is submitted and accepted.
We reserve the right to correct pricing errors, typographical errors, inaccurate product information, or other errors appearing on our website.
If an order is affected by a material pricing or listing error, we may cancel the order and issue a refund for any amount already paid.
4. ORDERS AND ORDER ACCEPTANCE
Submitting an order does not necessarily constitute our acceptance of that order.
We reserve the right to accept, reject, limit, or cancel an order for legitimate business reasons, including:

- Suspected fraud or unauthorized transactions;
- Shipping or delivery limitations;
- Unusually large quantities;

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled portion of the order.

Applicable sales taxes may be calculated and collected based on the shipping destination, applicable law, and information provided by the customer.
Customers claiming tax-exempt status are responsible for providing valid and current exemption documentation when required.
7. SHIPPING AND DELIVERY
Orders are shipped to the delivery address provided by the customer during checkout.
Customers are responsible for providing a complete and accurate shipping address. Sierra Hygiene Products is not responsible for delays, failed deliveries, additional shipping charges, or losses resulting from incorrect or incomplete information provided by the customer.
Shipping and delivery dates displayed or communicated to customers are estimates unless Sierra Hygiene Products expressly agrees otherwise in writing.
Delivery times may be affected by carrier delays, severe weather, natural disasters, transportation disruptions, holidays, labor disruptions, incorrect addresses, or other circumstances outside our reasonable control.
Once an order has been transferred to the shipping carrier, certain delivery changes may need to be coordinated directly with the carrier and may not be available.
8. DAMAGED, DEFECTIVE, INCORRECT, OR MISSING PRODUCTS
Customers should inspect shipments promptly after delivery.
If you receive damaged, defective, incorrect, or missing products, please contact Sierra Hygiene Products as soon as reasonably possible and provide the information necessary for us to investigate the issue.
We may request photographs of the product, shipping carton, packaging, shipping label, date code, lot code, or other relevant information.
Depending on the circumstances, Sierra Hygiene Products may provide a replacement, refund, credit, or another appropriate resolution at our discretion and in accordance with any applicable return or refund policy.
Customers should retain affected products and packaging until we confirm that they may be discarded.
9. RETURNS AND REFUNDS
Returns and refunds are subject to the return and refund policies displayed on our website or otherwise communicated to the customer at the time of purchase.
Products must generally be returned in their original condition and packaging unless the return involves a damaged, defective, or incorrect product.
Shipping charges, return shipping costs, restocking charges, and other fees may be nonrefundable where permitted by law and as disclosed in our applicable return policy.
Refunds will generally be issued to the original payment method.
Nothing in these Terms limits any rights that consumers may have under applicable law.
10. BUSINESS AND COMMERCIAL PURCHASES
Certain customers may purchase Sierra Hygiene Products for commercial, institutional, distribution, resale, or other business purposes.

If a separate written agreement between Sierra Hygiene Products and a business customer conflicts with these Terms, the separate written agreement will control with respect to that conflict.
11. PRODUCT USE AND DISPENSER COMPATIBILITY
Customers are responsible for determining whether a product is appropriate for their intended application.
Where products are identified as compatible only with particular dispensers, equipment, systems, or configurations, customers are responsible for verifying compatibility before purchase.
Sierra Hygiene Products is not responsible for damage or performance issues resulting from misuse, improper installation, improper storage, modification, use with incompatible equipment, or use inconsistent with product instructions.
12. ACCOUNTS
Certain features of our website may allow or require customers to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You agree to provide accurate and current account information and promptly update that information when necessary.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
17. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIERRA HYGIENE PRODUCTS AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OUR WEBSITE, SERVICES, OR PRODUCTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIERRA HYGIENE PRODUCTS' TOTAL LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT PAID TO SIERRA HYGIENE PRODUCTS FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
These limitations do not apply where liability cannot legally be excluded or limited.
18. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Sierra Hygiene Products and its owners, officers, employees, affiliates, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of our Services, violation of these Terms, infringement of third-party rights, or misuse of products purchased from us.
This provision does not require a consumer to indemnify Sierra Hygiene Products for claims arising solely from Sierra Hygiene Products' own unlawful conduct.
19. FORCE MAJEURE
Sierra Hygiene Products will not be responsible for delays or failures to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fires, floods, pandemics, epidemics, governmental actions, transportation disruptions, carrier delays, labor disputes, utility failures, raw material shortages, supplier disruptions, equipment failures, or similar events.
We will make commercially reasonable efforts to resume affected operations when practicable.

Your use of our website is also subject to our Privacy Policy.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

These Terms, together with our Privacy Policy, Return and Refund Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement between you and Sierra Hygiene Products concerning your use of our website and purchases through our online store.
Separate written agreements with business customers may supplement or supersede portions of these Terms as expressly provided in those agreements.
